Every Cooperative Housing Society (CHS) thrives on the collective efforts of its members. To maintain harmony and ensure smooth functioning, it is essential that every resident understands both their rights and duties as society members.  Right to Participate in Society Affairs

Every member has the right to attend General Body Meetings (GBMs) and actively participate in discussions and decision-making. Members can vote, raise queries, and express their opinions on important issues such as budgets, repairs, elections, and redevelopment. This democratic participation ensures transparency and accountability in the society’s functioning.

Right to Access Information and Records

Members have the right to access society records, including financial statements, meeting minutes, and audit reports. The Maharashtra Co-operative Societies Act mandates that societies maintain transparency by allowing members to inspect records upon request.  Right to Nominate and Transfer Ownership

Every society member holds the right to nominate a person who will inherit their share in the event of their demise. Similarly, a member can transfer ownership or membership rights to another person, subject to the society’s approval and compliance with bye-laws. This provision ensures continuity and clarity in property ownership.

Duty to Follow Society Bye-Laws

With rights come responsibilities. Each member has the duty to follow the bye-laws framed under the Maharashtra Co-operative Societies Act. These rules cover areas like maintenance payments, parking, noise levels, and use of common areas. Respecting these bye-laws ensures peaceful co-existence and prevents unnecessary conflicts.

 Duty to Pay Maintenance and Dues on Time

Timely payment of maintenance charges, sinking fund, and other dues is one of the most important duties of every member. These funds are used for repairs, cleanliness, water supply, and building safety. Delay or default in payment affects the entire community’s welfare and can result in legal action or penalties.

 Duty to Respect Common Property and Neighbors

Members must use common amenities responsibly and respect the rights of other residents. This includes maintaining cleanliness, avoiding damage to shared property, and ensuring that one’s actions do not cause inconvenience to others. A cooperative spirit and mutual respect are vital for creating a pleasant living environment.

 Right to Fair Treatment and Duty to Cooperate

All members have the right to fair and equal treatment irrespective of their ownership status or background. At the same time, they are expected to cooperate with the managing committee and participate in society initiatives like meetings, elections, and maintenance activities. Cooperation ensures that the society runs smoothly and democratically.
