If the request is for the <strong data-start=\"342\" data-end=\"360\">entire project<\/strong>, there must be <strong data-start=\"376\" data-end=\"394\">zero allottees<\/strong> \u2014 meaning no bookings or sales at all. In the case of <strong data-start=\"449\" data-end=\"476\">partial de-registration<\/strong>, that particular portion must also be free from any bookings. If there were previous bookings, the promoter must ensure that all such allotments are fully settled and submit <strong data-start=\"651\" data-end=\"686\">documentary proof of resolution<\/strong>. Additionally, if the remaining project is affected by the de-registration, <strong data-start=\"763\" data-end=\"793\">two-thirds (2\/3rd) consent<\/strong> of the remaining allottees is mandatory.<\/p>\n<p data-start=\"836\" data-end=\"1322\">If your project meets the eligibility criteria, the application process must follow the prescribed format. The promoter must email the application to <strong data-start=\"986\" data-end=\"1021\"><a class=\"cursor-pointer\" rel=\"noopener\" data-start=\"988\" data-end=\"1019\">secy@maharera.mahaonline.gov.in<\/a><\/strong>, using <strong data-start=\"1029\" data-end=\"1043\">Annexure A<\/strong> format, printed on the company\u2019s official letterhead. These include a <strong data-start=\"1402\" data-end=\"1443\">Notarized Declaration-cum-Undertaking<\/strong> (Annexure B). If the de-registration affects the balance project, <strong data-start=\"1510\" data-end=\"1535\">2\/3rd consent letters<\/strong> from the affected allottees must be attached. If any bookings had previously been made, the promoter must also attach a <strong data-start=\"1656\" data-end=\"1677\">list of allottees<\/strong> (with names, phone numbers, and emails) and <strong data-start=\"1722\" data-end=\"1756\">copies of settlement documents<\/strong> proving all issues have been fully resolved.<\/p>\n<p data-start=\"1803\" data-end=\"2271\">The promoter\u2019s declaration (Annexure B) must solemnly confirm that there are <strong data-start=\"1880\" data-end=\"1904\">no current allottees<\/strong>, or that <strong data-start=\"1914\" data-end=\"1940\">all buyers are settled<\/strong>. It must also state that no <strong data-start=\"1969\" data-end=\"2010\">litigation, complaint, or legal order<\/strong> is pending regarding the project and that there is <strong data-start=\"2062\" data-end=\"2087\">no mortgage or charge<\/strong> on the land. Further, the promoter must agree to comply with MahaRERA directions if <strong data-start=\"2172\" data-end=\"2225\">any buyer or complainant approaches in the future<\/strong>, and submit additional documents if required.<\/p>\n<p><iframe loading=\"lazy\" title=\"MahaRERA Parking Rules #werunsocieties #parking #society\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/NZQ9uqXdD4E?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p data-start=\"2273\" data-end=\"2576\">After submission, the application is <strong data-start=\"2310\" data-end=\"2340\">reviewed by the Legal Wing<\/strong> of MahaRERA. If necessary, it may be presented before the Authority for a hearing. If a <strong data-start=\"2429\" data-end=\"2454\">complaint is received<\/strong> from any stakeholder, MahaRERA will conduct a <strong data-start=\"2501\" data-end=\"2521\">separate hearing<\/strong> and pass a <strong data-start=\"2533\" data-end=\"2559\">binding speaking order<\/strong> on the promoter.<\/p>\n<p data-start=\"2578\" data-end=\"2939\">Promoters must note that de-registration is a <strong data-start=\"2624\" data-end=\"2651\">legal closure mechanism<\/strong>, not an escape route. It is suitable only when the project <strong data-start=\"2711\" data-end=\"2731\">hasn\u2019t taken off<\/strong>, is <strong data-start=\"2736\" data-end=\"2747\">stalled<\/strong>, and has <strong data-start=\"2757\" data-end=\"2801\">no viable legal or financial way forward<\/strong>.
