Co-operative Housing Society Registration needs 51 % of the Promoters to form Co-op. Housing Society

**Society Registration can be done with or without the help of Builder.

Conveyance Deed

It is mandatory for land owners/developers to convey the title of the plot within four months after the formation of the housing society. In many cases, the builders fail to convey the title of properties to the housing societies, in the hope of availing more floor space index (FSI) that may become available in future, or to avail the benefits accrued to them in case the property is redeveloped.

If the builder fails to convey the property, the Maharashtra Ownership Flats Act (MOFA) allows societies to apply for deemed conveyance

Form of Application under sections 18 and 19 .- (1) Every Application under sub-section (5) of section 18 shall be in Form I and accompanied by, wherever possible, certified copies of the following documents:

  1. The registered Agreement for Sale entered into with the Promoter or Opponent Party
  2. 7/12 Extract, Village Form No. 6 (Mutation Entries), Property Card,
  3. Building Plan approved by the Appropriate Planning Authority,
  4. Completion Certificate / Occupation Certificate / Affidavit
  5. List of Flat Purchasers and list of unsold Flats,
  6. Index II of all Owners
  7. Legal notice sent to the Promoter demanding the formation of the Co-operative Housing Society or the Association or the Company as provided under the Act.
