Readers, welcome back! In this article, we’ll look at the procedure for incorporating name on 7/12 Extract or Property Card. Following the execution and registration of the Sale deed, Assignment deed, Mortgage deed, an application in the prescribed format must be submitted to the Talathi office. According to the Maharashtra Land Revenue Code, 1966 and the Maharashtra Land Revenue Record of Rights and Registers (Preparation and Maintenance) Rules, 1971, each application must be processed by the Talathi. Talathi should immediately record the change in the register upon receipt of the application. The entire copy of the entry that Talathi will change in the register should be displayed prominently in the Chawdi; the notice is now available on the e-Chawdi. All individuals who are likely to be affected by the mutation should then be notified in writing via the rights of record or Mutation Entry register. The Mutation entry is written in pencil and it is necessary to write a remark that the Mutation entry has not been certified properly.

When there is no objection to the mutation:

  • The period for raising an objection to a mutation entry is 15 days.
  • If there is no objection or objection within fifteen days, the Circle Officer or City Survey Officer certifies the entry in the Mutation Entry registry.
  • This certified Mutation entry is to be recorded in ink in the record of rights by Talathi. This entire process can take up to thirty days.
  • This ensures that if no objections are raised, your name should be incorporated on the 7/12 Extract and Property Card within 30 days.

When there is objection to the mutation:

  • If the Talathi receives an oral or written objection to an entry in the Mutation Entry Registry, the Talathi must record the details of that objection in the specified register of disputed cases.
  • If an individual objects to an entry, the Talathi must immediately give an acknowledgement of the objection in writing using the prescribed form.
  • After taking into account both parties’ opinions, the Circle Officer or City Survey Officer certifies or cancels the entry.
  • If the entry is authenticated, Talathi wants to record it in ink in the rights of record, and if the entry is canceled, the entry made in pencil in the rights of record is to be erased.

 

If Talathi is avoiding you, you should:

Any dishonest and unethical Talathi would most likely refuse to change their records. As a result, after filing an application to the Talathi, you should file an RTI application on the fourth or fifth day to obtain the following details

  • Attested copy of the documents related to the action taken by your office on the application filed on (date of application).
  • A copy should be provided if a notice has been issued under Section 150 (2) of the Maharashtra Land Revenue Code. If there are any objections to the change, an attested copy of the page in the disputed register containing the relevant objection should also be provided.
  • If the Circle Officer visits your office after the application dated (Date of Application), an attested copy of the records of the Circle Officer’s visit should be provided.

Remember! Applying through RTI will take a big leap. You will also be notified if there are any flaws in the application.

If Talathi doesn’t take any action, you should:

If Talathi, Circle Officer and City Survey Officer do not respond to your application after filing it under RTI, you may take disciplinary action against Talathi, Circle Officer and City Survey Officer for violating Section 10 of the Maharashtra Government Servants Regulation Of Transfers And Prevention Of Delay In Discharge Of Official Duties Act, 2005 . You may even complain to the Principal Secretary (Revenue), Divisional Officer, and Collector in writing. Send the complaint by post then make an application to the Principal Secretary Revenue, Divisional Officer and Collector under RTI and seek information about the action taken on your complaint. Make sure to follow up on an application made under RTI. As per the Section 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005 mandates that any government officials respond to an application within seven days. In addition, RTI applications must be resolved within 45 days.
