Bye-Laws amendments for housing society disputes resolutions

Grievance Redressal and Advisory Committee:

Members of several housing societies are fed up with office bearers’ arbitrary decisions.  Members do not have time to complain to the Registrar.

The bye-laws can be amended as per Section 13 of the Maharashtra Co-operative Societies Act, 1960.

At such times, time should be saved. The issue should be addressed within the society itself. The following should be included in the bye-laws by amending the bye-laws in order to ensure that the society’s atmosphere is free of disputes.

The following text should be included in Bye-law No. 174.

174: If the Member/Members are not satisfied by the decision of the Committee, or does not receive any communication from the committee within 15 days, the complainant Member can file complaint or grievances with the society’s grievance redressal and advisory committee constituted by the general body of the society. The composition and powers of such committee shall be as decided by the general meeting.

By-law No. 174A should be included with the following text.

174A: Grievance Redressal and Advisory Committee
“At the general meeting, a committee of three active members of the society will be constituted. Society Committee members cannot be appointed in this Advisory Committee. The chairperson of this Advisory Committee will be the senior member from among the appointed members. If the Member/Members are not satisfied by the decision of such Advisory Committee, the complainant Member may approach below mentioned Competent Authority.”

In order to amend the Bye-Laws, the resolution must be passed by a 2/3rd majority of the members present at the general meeting, which must be approved by the registrar and only then the Bye-Laws came into force.

This advisory committee can solve many internal disputes, saving both time and money. Living in peace and happiness can be a reality.
