Today, we will explain everything you need to know about parking rights under MahaRERA regulations. This includes rules for garages, covered parking spaces, and open parking areas, based on MahaRERA’s Circular No. 36/2021 and Order No. 54/2024.
In a real estate project, there are three commonly used types of parking arrangements. First, a Garage – an enclosed structure meant for parking, usually with walls and a shutter or door. Second, a Covered Parking Space – includes parking provided in basements, stilts, podiums, or mechanized systems. Third, an Open Parking Area – simply a marked parking spot in an open area without any covering. According to MahaRERA, each type has a specific legal meaning and must be treated differently.
As per Circular No. 36/2021, open parking areas form part of the common areas of a real estate project. This means the builder cannot charge money for allotting an open parking spot. Open parking is free of FSI and is meant for common use by all allottees. Any attempt by the builder to sell open parking separately is a violation of RERA law and is punishable. If you are being asked to pay for open parking, you have the right to say no and report it to MahaRERA.
As per Order No. 54/2024, it is now compulsory for the builder to clearly mention the following details in the Allotment Letter and the Agreement for Sale:

The parking number allotted to you

The exact size and dimensions of the parking slot

The location of the parking – such as basement, podium, stilt, or open area
These details must also be matched with the approved layout plan, and a copy must be annexed to the agreement. This ensures transparency and helps prevent parking-related disputes in the future.
